White House Authorizes Lethal Force At The Border

President Trump’s chief of staff John Kelly signed a memo late Tuesday allowing troops stationed at the border to act in a law enforcement capacity and use lethal force, if necessary, according to Tara Copp of Military Times.

The new “Cabinet order” was signed by White House Chief of Staff John Kelly, not President Donald Trump. It allows “Department of Defense military personnel” to “perform those military protective activities that the Secretary of Defense determines are reasonably necessary” to protect border agents, including “a show or use of force (including lethal force, where necessary), crowd control, temporary detention. and cursory search.”

Kelly said in the signed directive that the additional authorities were necessary because “credible evidence and intelligence” have indicated that the thousands of migrants who have now made their way to the U.S. checkpoint near Tijuana, Mexico, “may prompt incidents of violence and disorder” that could threaten border officials. –Military Times

Approximately 5,900 active-duty troops were deployed to the southern US border along with 2,100 national guard to reinforce the border and bolster enforcement efforts as thousands of asylum seekers from Central America arrive in Tijuana, Mexico in the hopes of pushing into the United States. 

The Trump administration’s move may raise concerns over the 1878 Posse Comitatus Act, which prohibits the use of federal military personnel to enforce domestic policies within the United States.  

Some of those activities, including crowd control and detention, may run into potential conflict with the 1878 Posse Comitatus Act. If crossed, the erosion of the act’s limitations could represent a fundamental shift in the way the U.S. military is used, legal experts said.

The Congressional Research Service, the non-partisan research agency for Congress, has found that “case law indicates that ‘execution of the law’ in violation of the Posse Comitatus Act occurs (a) when the Armed Forces perform tasks assigned to an organ of civil government, or (b) when the Armed Forces perform tasks assigned to them solely for purposes of civilian government.” However, the law also allows the president “to use military force to suppress insurrection or to enforce federal authority,” CRS has found. –Military Times

That said, US military forces always have the inherent right to self defense. Moreover, troops have been given a wider scope of authority in recent years to assist border agents with various actions such as drug interdiction. 

According to Military Times, defense officials say that the language in the new directive was “carefully crafted to avoid running up against the bedrock legal limitations set in Posse Comitatus.” That said, “Even [an executive order] couldn’t overcome Posse Comitatus,” says Willaim Banks, author of “Soldiers on the Home Front: The Domestic Role of the American Military” and the former director of the Institute for National Security and Counter-terrorism at Syracuse University’s College of Law.

The new report appears to contradict a story from Tuesday in the Los Angeles Times that the Trump administration would begin withdrawing the troops. In fact, it appears that the pulled troops would primarily consist of engineering units which have finished their task of installing razor wire and physical obstacles at border crossing points – while the original scope of the mission had authorized a deployment until December 15, unless the Department of Homeland Security requested an extension.

Waves Of Caravan Migrant Invaders Arrive In Tijuana, Begin Climbing San Diego Border Fence

As the first waves of Central American migrants arrive in Tijuana, dozens of people on the Mexican side of the border could be seen scaling the border fence – which oddly has a wide platform at the top, and none of the razor wire recently deployed further inland.

Border Patrol released a statement Tuesday that said they believe some of those at the fence are members who were traveling as part of the Central American migrant caravan that originated in Honduras.

Migrants who reached the border fence in that area are from Honduras, Guatemala, Nicaragua, and El Salvador. Many are walking and will still need more time to reach the border, and those who have arrived already appeared to do so with the help of buses or other transportation. –Washington Examiner

On Monday, the first wave of migrants arrived in Tijuana; approximately 80 gay, lesbian and transgender asylum seekers who were bussed ahead by an anonymous organization after they say intolerant fellow asylum seekers were harassing them.

We were discriminated against, even in the caravan,” said Erick Dubon, 23, from San Pedro Sula, Honduras, who has been traveling with his boyfriend, Pedro Nehemias, 22. “People wouldn’t let us into trucks, they made us get in the back of the line for showers, they would call us ugly names.” –WaPo

Meanwhile, US Customs and Border Protection (CBP) announced that work began on Tuesday to “harden” the border crossing between Tijuana, Mexico and San Diego, using razor wire and other measures. Just not at the beach, apparently.

As we reported on Tuesday, CBP closed four lanes at the heavily trafficked San Ysidro and Otay Mesa ports of entry in San Diego in order “to install and pre-position port hardening infrastructure equipment in preparation for the migrant caravan and the potential safety and security risk that it could cause,” according to CBS News and PBS

On Thursday, 1,100 Marines from Marine Corps Base Camp Pendleton in California were deployed to support border security, CBS San Diego affiliate KFMB reported. They were primarily tasked with installing concertina wire and pre-positioning jersey barriers, barricades and fencing.

The thousands of Central American migrants left shelters in Guadalajara early Tuesday and were taken by bus to a highway tollbooth to wait for rides to their next destination. Most appeared intent on taking the Pacific coast route northward to the border city of Tijuana, which was still about 1,350 miles away. The migrants have come about 1,500 miles since they started out in Honduras around October 13. While the caravan previously averaged only about 30 miles a day, the migrants are now covering daily distances of 185 miles or more, partly because they are relying on hitchhiking rather than walking.

Excellent reporting from Ami Horowitz (Daily Wire) who traveled to Mexico to find out the real reason why there is a caravan of migrants on its way to the United States’ border with its southern neighbor.  Within the video report you can get an understanding of who is inside the group (95% young males); and why they are making the journey.

Horowitz actually embeds with the migrants to ask questions and understand how it is logistically possible for tens-of-thousands of people to travel, eat and sleep over such a great distance.  What he discovers is the network of facilitating agencies who are spending tens-of-millions to challenge U.S. sovereignty and overwhelm our immigration laws.
